Joseph J. Brophy

Counsel

Professional Profile

Joseph J. Brophy is a member of our Business Litigation and Surrogate's Court Litigation groups, and chairs the firm's Medical Malpractice & Personal Injury and Legal Malpractice groups. Joe is also known as one of the leading plaintiff's medical malpractice litigators based in the Hudson Valley. As indicated by his representative cases, Joe has had numerous successful lawsuits involving different types of doctor or hospital errors, including misdiagnosis or delayed treatment of cancer, drug and medication errors, surgical and anesthesia complications, emergency medicine treatment, birth injuries, foreign object injuries and wrongful death cases. Joe has also obtained large recoveries for victims of construction accidents and auto accidents. Joe offers expert support to individuals gravely injured, and the families of those who have died, as a result of negligence and medical malpractice.

Joe is an experienced and passionate advocate for clients who have been harmed through the Legal Malpractice of his client's prior lawyers. Joe's client-centered approach to legal practice makes him particularly sensitive to the betrayal every client suffers when a lawyer, through negligence or deliberate intent, falls short of the standards of competence and ethics that our firm demands of ourselves. In addition to his experience in Legal Malpractice cases, Joe has represented clients who were victims of their lawyer's misuse of their funds or engaged in deception in court proceedings.

Joe is one of the few Board Certified Civil Trial Advocates in the State of New York. He has also been recognized six times as a New York Super Lawyer in the area of Medical Malpractice and has also been selected as one of Westchester's top 25 lawyers in 2009, 2011 and 2012.

His trial experience, with scores of jury verdicts to his credit, gives him credibility in settlement negotiations, mediations, and arbitrations. Cases that are successfully resolved often generate very significant recoveries. Joe’s work on such cases is not concluded until individualized plans for investment and protection of the clients’ funds are finalized. The firm’s strengths in the areas of Trusts & Estates, elder law and Taxation offer an added dimension of service to clients who need to manage large personal injury and wrongful death recoveries.

Joe is also a proud contributor of Avvo, a web site that permits members of the internet community to have a source of legal advice. Avvo has awarded Joe a rating of "Superb"' and a "10".
