David's clients, who include software developers and others in the information technology field, seek his advice regarding numerous technology and web site management issues. Amongst other things, David helps client deal with rights in open source software, development of social media sites, and policies for the collection, safeguarding and dissemination of proprietary and personally identifiable information.

April 09, 2012David A. Menken, a member of our Intellectual Property and Corporate & General Business groups, has achieved certification as an Information Privacy Professional ("CIPP"), with a specialty in US privacy laws and policies, through the International Association of Privacy Professionals. The "CIPP/US" credential is earned by demonstrating a strong foundation in U.S. privacy laws and regulations and an understanding of the legal requirements for the responsible transfer of sensitive personal data to/from the United States, the European Union and other jurisdictions. David has expertise in advising businesses which collect data using traditional methods and via the Web on compliance with data security and privacy laws and policies.
March 29, 2012Robert J Kiggins, a member of our Corporate and Taxation groups, who devotes part of his practice to representing hedge funds, was interviewed by Hedge Funds Review on "The Jumpstart Our Business Startups (Jobs) Act" that was recently signed into law by President Obama. Subject to SEC regulation, that law eliminates long-standing restrictions on advertising by hedge funds.
"This is a potential game changer," says Robert Kiggins, counsel at the law firm McCarthy Fingar. "Subject to the SEC rule-making, this means hedge funds can promote and market their products through mass media channels, from television adverts to newspapers articles and websites."
March 12, 2012David A. Menken, a member of our Intellectual Property and Corporate & General Business groups, spoke on laws relating to municipal government use of social media at the Westchester Municipal Planning Federation's Land Use Training Institute, at Pace University’s Lubin Graduate Center in White Plains on March 12, 2012. His discussion touched on the benefits of social media to local government and compliance with "open government" requirements. He also reviewed the various elements of social media policies that he recommends to his governmental clients. Many of these issues are discussed in David's outline.
February 27, 2012David A. Menken, a member of our Corporate & General Business and Intellectual Property groups, has been named to the Board of Governors of the World Trade Council of the Westchester County Association. The World Trade Council is the international trade arm of the Westchester County Association. Its mission is to promote and facilitate international trade for companies within Westchester County and the lower Hudson Valley. This includes helping local companies expand their international presence as well as highlighting Westchester County as a venue for international investment and partnerships.
February 23, 2012David A. January 01, 2012Robert J. Kiggins and Howell Bramson, both members of our Corporate and Taxation groups, have authored the United States chapter to a book edited by Roy Saunders, of International Fiscal Services, based in London, entitled “International Tax Systems and Planning Techniques”. The book covers the tax laws of over 30 countries, including most of the European Union, portions of Asia and Eastern Europe, the United States, Brazil and Canada, and a number of offshore tax havens. The purpose of the book is to assist in the tax analysis of cross border transactions and investments.

November 03, 2011Along with the emergence of the global economy and the ever increasing exposure of companies and high net worth individuals to economies and tax regimes outside of their home country, migration for tax and business reasons is becoming increasingly common. Robert J Kiggins, a member of our Corporate and Taxation groups, lectured and participated in an international expert panel discussion at the Second Annual Conference of the International Tax Systems and Planning Techniques (ITSAPT) Professional Association to be held in London, England on November 3, 2011. Bob covered the topic of personal migration to the United States for social, personal business and tax reasons. The first part of the Conference discussed the complex issues involved in corporate/business migration, such as change of legal domicile or place of organization, change in place of management or control, and considerations involved in international mergers. The second part of the Conference discussed individual migration issues, such as residence and domicile, beneficial tax regimes for individuals migrating into a country, pre-immigration planning, including the use of trusts and foundations, and beneficial structures used to acquire real estate for personal use in the countries involved in a migration.

At this program, Bob covered many Form 1099 topics, including: due dates for providing and filing Form 1099s; penalties for non-compliance; most common types of 1099 filings; the distinction between independent contractors and employees; procedures for obtaining IRS determination of independent contractor or employee status of workers; electronic Form 1099 submissions; and Form 1099 error corrections. This prestigious decoration, which was awarded to Paul by the President of the Republic of Brazil, recognizes Paul's commitment and dedication to Brazil, Brazilian companies and to the Consulate General of Brazil in New York. The Order of Rio Branco was created in 1963 to recognize and celebrate the merits of Brazilian and foreign individuals who have significantly contributed to the promotion of Brazil's relations with the world. June 22, 2011Robert J Kiggins, a member of our Corporate and General Business group who concentrates in financial services clients, was interviewed by Reuters in an article about regulatory oversight of investment advisors. "Robert Kiggins, a lawyer in White Plains, New York who specializes in financial services clients, said the new regime creates complexities and the potential for lapses. 'Some of these states will without a doubt do a worse job than the SEC at regulating investment advisers,' he said, citing funding issues, the multi-state operations of some advisers and the increasing globalization of financial markets. 'Shifting regulation from a national level via the SEC to the states via the various state regulators is clearly a step in [the] wrong direction.'

Byrnes, IV of Thomas Jefferson School of Law in San Diego, California, on writing the 2011 revisions to the US Chapter of “International Tax Systems & Planning Techniques”, a book on cross border personal and business financial transactions and related tax implications. The revisions will be designed to keep abreast the ever accelerating changes in this field. For example, in view of the expansion of Internet trading as a major element in today’s global economy, the revisions to the US Chapter will highlight some of the international tax issues facing Internet trading companies. The 2011 Edition of the book is targeted for release and publication in the Spring of this year.
