Family & Divorce Mediation

Introduction

The McCarthy Fingar Mediation & Arbitration Practice Group helps couples who have decided to end their relationship through separation and/or divorce to consider all of the issues commonly addressed in a Separation Agreement as well as any other matters unique to them. These may include equitable distribution of property, spousal support or maintenance, child support, decision-making and parenting arrangements (sometimes called custody and visitation). In addition, we help couples create pre- and post- nuptial agreements. 

Best Interests of the Children

We believe that mediated agreements serve the best interest of the children by increasing the possibility of active and supportive parenting and decreasing the intensity of parental conflict. Parents participating in mediation work together to figure out the practical, logistical and financial arrangements that will support the goals that they have for their children and for themselves as parents. As children grow, or circumstances change, parents may elect mediation as a process for revisiting prior parenting-related decisions made at the time of their separation, divorce or dissolution of their relationship.

We Can Help

Leading our mediation practice is Judge Sondra M. Miller, a retired Family Court, Supreme Court, and Appellate Division Judge. She was appointed to lead a Commission to review and recommend improvements to New York State matrimonial law and practice. The seminal Miller Commission made specific recommendations to improve “the administration of divorce litigation and all the attendant matters to the end of reducing undue trauma, cost and delay to the parties and, most importantly, the children.” In particular, the Commission concluded that use of alternative dispute resolution processes, such as mediation should be utilized in matrimonial matters, particularly those involving children as an effective means of reducing the delay, expense and trauma to children often experienced during divorce.

Our practice group also includes Abby P. Rosmarin, who is both an attorney and a NYS Licensed Mental Health Counselor. She understands both the legal issues and the interpersonal dynamics that couples face. Abby is experienced in helping clients overcome the barriers to resolving emotionally charged conflicts in order for them to make sound decisions that work best for the couple.

Kristen Mackay Pennessi concentrates her practice in matrimonial and family matters. Kristen’s experience as a litigator helps people understand the value of mediation to reduce emotional damage, contain financial cost, as well as facilitate the parties to reach an agreement on terms that are fashioned to their specific needs.
