  • Philip T. Temple, Esq., Former McCarthy Fingar Partner Dies

    With deep sadness, we report that one of our former partners, Phil Temple, died on August 16, 2013, after a long illness. Phil was a beloved partner of the firm and had co-chaired our Charitable Gift Planning and Exempt Organizations groups. Phil received his undergraduate degree in English from City College of New York in 1954 and an LL.B. from Columbia University in 1957.

     

    Beyond his leadership role at McCarthy Fingar, Phil was one of the leading practitioners and lecturers in the field of gift and estate planning for more than 50 years. Phil devoted much of his practice to personal planning for non-profit institutions and philanthropists, major gift planning for non-profit institution development offices, and personal estate planning for individuals. Phil was a frequent lecturer on the tax aspects of philanthropy before many charitable organizations and educational organizations, such as the following: Albertson College, American Heart Association, American Institute for Philanthropic Studies, American Institute of Certified Public Accountants (AICPA), American Red Cross (Cincinnati Area Chapter), Arthritis Foundation, Association for Health Care Philanthropy, Association of Development Officers (Westchester Chapter), Association of the Bar of the City of New York, College Miscricordia, Council on Foundations, Estate Planning Council of New York City, Financial Planning Association, Foundation for Accounting Education, Israel Humanitarian Foundation, Jewish Community Board of Akron, Jewish Community Foundation of Southern Arizona, Jewish Federation of Greater Philadelphia, Lorman Educational Services, Metropolitan Jewish Geriatric Foundation, Middlebury College, National Association of Philanthropic Planners, National Conference on Planned Giving, New York Public Charities, New York State Bar Association, New York University, Orchard Foundation (the supporting organization of The Christian and Missionary Alliance), Pace University, Planned Giving Council of New Jersey, Planned Giving Group of Connecticut, Planned Giving Group of Greater New York, Practising Law Institute, St. Luke's Health Foundation, The New York Botanical Garden, UJA Federation of NY, United Jewish Communities, United Jewish Communities, United Way of Westchester and Putnam, Westchester Chapter of the New York State Society of Certified Public Accountants.     Phil was also a former chair of the Committee on Non-Profit Organizations of The Association of the Bar of the City of New York.

     

    Phil is survived by his three children, Eric, Adam and Pamela, and four grandchildren. Condolences can be sent to Adam and Amy Temple, 629 Kappock Street, Bronx, NY 10463. The family asks that in lieu of flowers, please remember Phil by making a contribution to the UJA Federation of NY.

     

    A memorial service was held on August 23, 2013 at Riverside Memorial Chapel, 180 West 76th St, New York, NY.

  • Streng in the News, Again, on his Nissan Leaf

    Frank W. Streng, who chairs our Surrogate’s Court Litigation group, continues to be in the news on his Nissan Leaf electric car. Previously, Frank was interviewed by News 12 Westchester as the first owner of the Nissan Leaf in Westchester. This time, Frank was interviewed by the New York Times on how he faired with his Leaf during Sandy, when he had no power at his home to charge his car. As the Time reports: “With no power (or generator) at home, Mr. Streng has been using a public charger at the White Plains train station, a couple of blocks from his office. 'I’m now using that as a primary energy source,' Mr. Streng said. 'It’s my third day in a row doing it. It’s worked out fine.'”

Boggio has been appointed as an Article 81 Court Examiner for Westchester County by Gail Prudenti, the Presiding Justice in the Appellate Division, Second Department. Prior to her appointment as Court Examiner, Gail, who is also a certified public accountant, satisfied various training and educational requirements established by Justice Prudenti. As Court Examiner, Gail's duties include examining the reports of guardians to ascertain whether such guardians have timely filed reports and accountings as required by Article 81 of the Mental Hygiene Law.  As Court Examiner, Gail must also certify whether such guardians have satisfied their statutory duties and the provisions of the court order appointing them.

    Robert J Kiggins and Howell Bramson, members of the Firm’s Corporate and Taxation groups, are working with the IFS Consultant Group, based in London, England and headed by Roy Saunders as Chairman, and with Prof. William H.  Byrnes, IV of  Thomas Jefferson School of Law in San Diego, California, on writing the 2011 revisions to the US Chapter of  “International Tax Systems & Planning Techniques”, a book on cross border personal and business financial  transactions and related tax implications. The revisions will be designed to keep abreast the ever accelerating changes in this field. For example, in view of the expansion of Internet trading as a major element in today’s global economy, the revisions to the US Chapter will highlight some of the international tax issues facing Internet trading companies.  The 2011 Edition of the book is targeted for release and publication in the Spring of this year.

  • Kidnapped Baby, for whom Trust Fund was Created, Reunited with Parents

    In 2004, the firm's web site contained the following item on firm news:

     

    "As part of her representation of clients who were upset that a lawyer, acting as trustee of a trust fund created for a baby kidnapped from Harlem Hospital in 1987, had not provided proper accountings on the trust, Lisa Newfield, working with Frank W. Streng, had reviewed the lawyer’s records, identified improper withdrawals from the trust by the lawyer and ultimately forced the lawyer’s resignation as trustee. The lawyer had been the subject of a disciplinary complaint before a Disciplinary Committee of the Appellate Division, First Department. Lisa and the firm fully cooperated in this investigation. Citing Lisa’s investigatory work on the trust, the First Department, having first suspended the lawyer from practice, adopted the recommendation of its Disciplinary Committee and disbarred the lawyer in a decision and order dated August 12, 2004. The case has also been reported by different news publications."

     

    In a remarkable development, in January, 2011, the kidnapped baby herself, Carlina White, through a diligent search of the website of the National Center for Missing and Exploited Children, was able to identify herself as a missing baby and find her parents, Joy White and Carl Tyson.  The New York Daily News initially broke the story and reported, on January 19, 2011, that Carlina, whose name was changed to Nejdra Nance, was reunited with her parents in early January, 2011.  The joyful story was a lead story for ABC News on January 19th and is now being reported by major media outlets throughout the country, including CNN.

    As part of her representation of clients who were upset that a lawyer, acting as trustee of a trust fund created for a baby kidnapped from Harlem Hospital in 1987, had not provided proper accountings on the trust, Lisa Newfield, working with Frank W. Streng, had reviewed the lawyer’s records, identified improper withdrawals from the trust by the lawyer and ultimately forced the lawyer’s resignation as trustee. The lawyer had been the subject of a disciplinary complaint before a Disciplinary Committee of the Appellate Division, First Department. Lisa and the firm fully cooperated in this investigation. Citing Lisa’s investigatory work on the trust, the First Department, having first suspended the lawyer from practice, adopted the recommendation of its Disciplinary Committee and disbarred the lawyer in a decision and order dated August 12, 2004. The case has also been reported by different news publications.

On that occasion John offered his services on a pro bono basis to give legal advice on wills, trusts, powers of attorney and living wills and health care proxies to persons who attended the meeting. Each session with a client lasted one half hour and he offered to prepare documents in situations where they were warranted and requested.
