McCarthy Fingar's expertise in a wide range of legal specialties is a unique asset for our clients. Our lawyers have successfully represented clients in legal malpractice cases arising from a wide variety of situations, and have also served as expert witnesses on behalf of both lawyers and clients in legal malpractice litigation. Our client-centered approach to legal practice makes us particularly sensitive to the sense of betrayal every client suffers when a lawyer, through negligence or deliberate intent, falls short of the standards of competence and ethics that we demand of ourselves. As lawyers ourselves, we recognize the pitfalls of legal practice, and our attitude toward other lawyers when we are obliged to sue them is more often one of sorrow than of anger. Our first duty is, of course, to our clients, and in such situations we do our utmost to earn from our clients the trust and respect that their prior attorneys lost.

Legal Malpractice lawsuits have increased as law practice has become more complex. Such cases may arise from a missed Statute of Limitations, a late filing, failure to sue the proper party, errors in preparing documents, mishandling of client funds or improperly paying out funds, to give just a few examples.

The large majority of legal malpractice cases we undertake result in out of court settlements for our clients; relatively few go to trial. Some such cases may result in ethics complaints being lodged against the defendant attorneys. Most of the local grievance committees will not consider ethics complaints against lawyers while court proceedings are pending. The threat of a grievance or a prosecution is never an ethical bargaining tool in any type of litigation. Conversely, clients need not abandon legitimate grievances against attorneys as part of the settlement of a lawsuit.
